The firm provides expert advice on the advertisement of drugs permitted under the law.The Act has been passed to control certain types of advertisements relating to drugs and certain kinds of advertisements about magical remedies that falsely claim and mislead the public. There are three-way prohibitions imposed under the section. Prohibition against the advertisement of certain drugs to treat certain diseases and disorders specified in the Schedule. It also prohibits misleading advertisements relating to drugs. It provides that no person shall take any part in the publication of any advertisement relating to a drug if the advertisement directly or indirectly gives a false impression regarding the true character of the drug or makes a false claim for the drug or any advertisement which makes false or misleading claims in any material particularly with regards to the drug.
Prohibition of advertisement of magic remedies for treating certain diseases and disorders. No person shall advertise any magic remedy that claims directly or indirectly to be efficacious for treating certain diseases and disorders. It also prohibits advertisements containing false claims for the drugs it treats or any false claim as to the usefulness of the drug for particular claims, etc.
Rule 106 also restricts the advertisement of the drug's usefulness. Caution must be taken by the Companies at the time of advertisement, which shall not violate the provisions of rule 106 and the Drugs And Magic Remedies (Objectionable Advertisements) Act, 1954.
